- Consent required: SMS messages are sent only to recipients who have provided explicit prior consent, captured via the public demo signup at https://prodcomm.com/demo, a signed deal memo or employment paperwork with the hiring production, or verbal consent during voice onboarding
- Message types: Call sheet distribution, schedule updates, location and parking information, onboarding instructions, safety messages, signature requests, and responses to crew inquiries
- Frequency: Variable, depending on production phase. Typically higher during shoot days, lower during prep and wrap
- Opt-out: Recipients may opt out at any time by replying STOP, QUIT, CANCEL, UNSUBSCRIBE, or END to any message. Opt-out is honored immediately and the recipient is suppressed from future SMS for that production

3. Not a Professional Services Provider
ProdComm is a technology platform, not a law firm, tax advisor, accounting firm, payroll company, insurance broker, or financial advisor. The Service provides tools to help you collect information and generate forms, but does not provide legal, tax, financial, regulatory, or accounting advice of any kind.
You acknowledge and agree that:
- Form templates (W-4, I-9, state tax forms, deal memos) are provided for convenience and may not reflect the most current versions required by applicable government agencies
- You are solely responsible for verifying the accuracy and completeness of all generated forms before submission to any government agency, payroll provider, or other third party
- Workers compensation forms generated by the Service are informational aids only; ProdComm is not an insurance provider, broker, or claims administrator
- Tax withholding calculations and state tax form selection are based on information provided by users and may not account for all applicable rules or recent regulatory changes
- You should consult qualified legal, tax, and accounting professionals for advice specific to your production and jurisdiction
- Tax incentive projections are estimates based on user-configured percentages and total spend data — ProdComm does not guarantee the accuracy of state rebate calculations, qualified spend classifications, or tax incentive eligibility. Consult a qualified tax professional or your production's tax incentive advisor
- Per-union fringe rate calculations are based on publicly available union agreement data and may not reflect the most current rates, local variations, or production-specific sideletter modifications. Verify all fringe calculations with your payroll company or production accountant
- Hot cost reports are daily estimates intended for operational awareness, not for financial reporting. Formal cost reporting should come from your production accountant
- Talent deal tracking is a record-keeping tool — ProdComm does not negotiate, advise on, or enforce talent agreements. Consult your entertainment attorney or business affairs department for deal-related legal questions

6. Consent to Data Processing and Third-Party Sharing
By using the Service, you expressly authorize ProdComm to:
- Collect, process, store, and transmit crew member personally identifiable information, including SSNs, bank account numbers, government-issued IDs, and tax information, on your behalf
- Share such information with third-party service providers necessary to operate the Service, including but not limited to Twilio (telephony and SMS), ElevenLabs (AI voice), OpenAI (AI processing), and our cloud hosting infrastructure
- Transmit generated forms and onboarding data to payroll companies, government agencies, or other recipients as directed by you
You represent and warrant that you have obtained all necessary consents from crew members whose personal information you submit to the Service, including consent for the collection of sensitive personal information, voice recording, and electronic signature capture. You are responsible for providing appropriate privacy notices to your crew members.
7. Voice Recording, AI Consent, and Two-Party Consent Compliance
The Service uses AI-powered voice agents to conduct onboarding calls, answer crew inquiries, process injury reports, create location agreements, and route calls to departments. You acknowledge and agree that:
- Onboarding calls and crew hotline calls may be recorded for compliance, quality assurance, and training purposes
- Before activating the voice recording feature, you must affirmatively warrant in the production dashboard that you will comply with all applicable federal and state call recording laws. In two-party consent states (including California, Florida, Illinois, Maryland, Massachusetts, Montana, New Hampshire, Pennsylvania, and Washington), all parties on a call must consent to recording. Our AI voice agent discloses that the call is being recorded at the beginning of each call, but you remain solely responsible for ensuring compliance in your jurisdiction
- AI voice agents may occasionally misunderstand, misinterpret, or inaccurately transcribe spoken information
- AI-generated responses are provided "as is" and should not be relied upon as legal, tax, or professional advice
- You should review all data collected via AI voice calls for accuracy before using it in employment forms or official documents
- Voice recordings are stored securely and retained in accordance with our Privacy Policy
8. Electronic Signatures
The Service allows crew members to provide electronic signatures for employment forms, offer acceptances, location agreements, talent releases, and other documents. You acknowledge that:
- Electronic signatures collected through the Service are intended to comply with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act) and the Uniform Electronic Transactions Act (UETA, California Civil Code 1633.1-1633.17)
- Before signing, each signer must affirmatively consent to conduct the transaction electronically and demonstrate intent to sign. The Service captures this consent through a required acknowledgment step prior to signature capture
- Electronic signatures may not be legally enforceable for all document types or in all jurisdictions
- You are responsible for determining whether electronic signatures are appropriate and legally sufficient for your specific use case
- ProdComm captures and stores an audit trail for each signature, including timestamp, IP address, device information, and consent record, but does not guarantee the legal enforceability of any signature
9. Payment Terms
Pricing is determined on a per-production basis. Current pricing is available at prodcomm.com/pricing or by contacting us directly. We reserve the right to change pricing with 30 days notice. Failure to pay may result in service suspension.

15. AI Safety Disclaimer and Automated Decision-Making
Safety-Critical Information
You must independently verify all safety-critical information provided by the AI voice agent or any automated system before relying on it. This includes but is not limited to:
- Medical facility locations and directions provided during injury reports
- Safety meeting times and locations
- Call times, crew call schedules, and shooting locations
- Any information that, if incorrect, could result in physical harm, missed work, or financial loss
The official call sheet PDF distributed via SMS remains the authoritative source for all production information. AI-generated responses are informational aids and should be cross-referenced against official documents.
Automated Decision-Making Technology (ADMT)
The Service uses automated decision-making technology in the following ways:
- AI voice agent routing decisions (directing calls to departments or operator)
- AI-generated risk assessment hazard identification
- Turnaround violation detection (flagging insufficient rest periods)
- Approval workflow routing (determining which documents require sign-off)
These automated processes assist production coordinators but do not make final employment, scheduling, or safety decisions without human oversight. Users retain full control over all production decisions. If you wish to opt out of automated decision-making for any specific feature, contact us at privacy@prodcomm.com.
16. Minors on Set
Film and TV productions may involve minor talent members under the age of 16 or 13. If a minor will interact with the Service (including SMS check-in, onboarding, or talent release signing), the production company must:
- Obtain verified parental or guardian consent before collecting any personal information from the minor
- Ensure a parent or legal guardian completes all forms and signatures on behalf of the minor
- Comply with all applicable child labor laws and the Children's Online Privacy Protection Act (COPPA)
ProdComm's talent release feature includes guardian signature support for minors, but the production company is solely responsible for ensuring proper consent and compliance with applicable minor protection laws.

The arbitration shall be conducted in Los Angeles County, California. ProdComm shall bear all AAA filing fees and arbitrator costs; each party shall bear its own attorneys' fees unless the arbitrator determines otherwise.
Waiver of Jury Trial and Class Action
YOU WAIVE YOUR RIGHT TO A JURY TRIAL. YOU ALSO WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION, CLASS ARBITRATION, OR ANY OTHER REPRESENTATIVE PROCEEDING.
